The Breeder, Laura Westerfield and the Buyer(s), _______________________________________, agree, both individually and mutually as follows:

1. The Breeder sells to the Buyer, for the amount of $ ________, co-ownership of the below described Great Dane puppy:

DOB ____________, sex_____, color_______________, in accordance with the terms of this contract and herein referred to as this or the "puppy".

2.  Non-refundable deposit of $________received on _________.  Balance of $ _________  due upon pickup or delivery of the puppy or when the puppy is 8 weeks old, whichever comes first.

Breeder Guarantees:

1. Infectious Disease (Parvovirus, Distemper, etc..):  This puppy is in good health on the date of pickup or delivery.  It has received age appropriate vaccination(s) for Canine Distemper, Adenovirus Type 2 and Parvovirus.  It is required that Buyer(s) have this puppy fully examined by a vet within 72 hours of receiving it and must provide Breeder with receipt within 7 working days of exam or Buyer(s) will forfeit all of Breeder's guarantees in this contract.  If the puppy is determined at this exam to have an infectious disease, it may be returned to Breeder for a full refund of purchase price.  Breeder is not responsible for veterinary exam, x-ray, laboratory or other medical fees.

2.  Intestinal Parasites (Hookworm, Tapeworm, Roundworm, Whipworm, Giardia, Coccidia):  This puppy has been de-wormed every 2 weeks. Intestinal parasites are a normal occurence in puppies and this puppy may not be returned to breeder because of intestinal parasites.  If Buyer(s) chooses not to properly treat the puppy for parasites, Buyer(s) forfeits all of Breeder's guarantees in this contract.

3.  Genetic and Congenital Defects:  Limited to first 4 years of puppy's life ONLY if Buyer keeps all dog food and veterinary receipts showing proper diet and veterinary care.  If no receipts are presented, this guarantee is limited to the first 6 months of the puppy's life.  Contact the Breeder immediately if you or your vet suspects a congenital or genetic defect so a plan of action can be agreed upon between the contracting parties. Breeder reserves the right to limit her financial liability to the amount originally paid for the puppy by the Buyer(s) or to replace the puppy rather than agree to veterinary expense. Breeder will not be responsible for any expenses incurred without prior written agreement to said expenses.

~ Cherry Eye, Ectropian, Entropian or Eversion of Third Eyelid are ONLY covered if they are repaired at the same time the spay/neuter is performed.  Breeder will only pay a maximum of $85.00 per eye (so make sure your vet knows what s/he is doing the first time).
~ Hip Dysplasia - must be preceded by a preliminary hip x-ray at 6 months of age and must be diagnosed by 2 separate veterinarian practices after the puppy has reached the age of 2 years.  Breeder's vet must be provided with x-rays and agree with Buyer(s)'s veterinarian diagnosis.  Refunds will be as follows:  Diagnosis of "Mild" - refund of 25% of original purchase price, "Moderate" - refund of 50% of original purchase price, "Severe" - 75% of original purchase price.
~ Any Elbow Dysplasia diagnosis other than "Normal," by 2 separate veterinarian practices and Breeder's veterinarian after the puppy has reached the age of 2 years will receive a 50% refund of original purchase price.

~ Wobbler's Syndrome diagnosed before 2 1/2 years of age will receive a 100% refund of original purchase price upon presentation of veterinary documentation to Breeder and Breeder's veterinarian.
~ Addison's Disease diagnosed before 4 years of age will receive a 100% refund of original purchase price upon presentation of veterinary documentation to Breeder and Breeder's veterinarian.
~ Cardiomyopathy must be diagnosed by 2 separate veterinarian practices and Breeder's veterinarian and is covered up to age 4 at the following rates - Heart Murmurs Grades I and II are not covered, Grade III - 10% refund of original purchase price, Grade IV - refund of 25% of original purchase price, Grade V - refund of 50% of original purchase price, Grade VI - refund of 100% of original purchase price.
~ Diagnosis of von Willibrand's Syndrome or Hypothyroidism by laboratory blood test will receive a refund of 25% of original purchase price.
~ Any other claims will be handled on a case by case basis and with the same equitable refund or replacement as described for other diagnoses herein.

Breeder will not require that the puppy be returned for replacement or refund in the case of a non-fatal congenital or genetic defect, but will require veterinary documentation of defect and of spay/neuter so it can stay with the Buyer(s) for the remainder of it's life.  In the case of fatal congenital or genetic defect, Breeder will require an autopsy report before providing replacement or refund.

Buyer Guarantees:
1.  This puppy must be spayed/neutered by the time it is 10 months old.  Buyer(s) must present proof of spay/neuter to Breeder by USPS mail prior to the date the puppy will be 10 months old to receive AKC limited registration application for the puppy.  Breeder will sign over full ownership of the puppy upon receipt of proof of spay/neuter.  Buyer(s) understands that if the puppy is NOT spayed/neutered and/or proof thereof not sent to Breeder by 10 months of age, Buyer(s) forfeits all Breeder's guarantees in this contract and Buyer(s) must surrender* full ownership of the puppy to Breeder or pay an additional $500.00 fee plus any attorney and court expenses necessary to enforce spay/neuter or return of this puppy.

2.  Upon receipt of AKC limited registration application, Buyer(s) may choose not to register puppy at all without penalty.  However, if Buyer(s) does register this puppy, they must use the Breeder's kennel name, "Teufelshund" as the prefix for this puppy's registered name, i.e., Teufelshund Tango.  Failure to use Teufelshund as the prefix for the puppy's registered name will result in forfeiture of all Breeder's guarantees in this contract.  If Buyer(s) registers this puppy with any other organization, such as CKC, APR or UKCi, without Breeder's written consent, Buyer(s) may NOT use Breeder's kennel name and will forfeit all of Breeder's guarantees in this contract.

3. This puppy will not be unnecessarily exposed to any other dogs or puppies, (with the exception of those currently owned by Buyer(s)), until it is 4 months old and has received all of it's puppy vaccinations. Buyer(s) guarantees that any dogs they own already are current on their vaccinations and healthy. Buyer(s) guarantees to Breeder that all precautions will be taken to keep this puppy in good health.  They shall maintain this puppy in good condition, including adherence to a regular immunization schedule as recommended by Breeder and/or veterinarian, heartworm preventative as recommended by veterinarian, proper diet and a clean and safe environment. Neglect of any of these will result in forfeiture of all Breeder's guarantees in this contract.  If proof is provided to Breeder by any party that the puppy is not being cared for properly to the extent that abuse or neglect is obvious, Breeder reserves the right to reclaim* the puppy, restore it to optimum condition and rehome it and Buyer will receive no reimbursement of purchase price or expenses.  Buyer(s), by their signature on this contract, agree to accept responsibility for all veterinary, boarding and care expenses until the puppy is rehomed.

4.  If at any time in the puppy's life the Buyer(s) cannot keep the puppy, the Buyer(s) guarantees to return* the puppy to the Breeder without expectation of reimbursement for purchase price or expenses. Breeder will, however, reimburse Buyer(s) if said puppy is resold, minus any expenses incurred by Breeder in doing so. If Breeder does give Buyer(s) permission to place the puppy themselves, new Buyer(s) must sign a modified contract with Breeder that will continue the puppy's congenital and genetics guarantee, spay/neuter agreement and any other relevant clauses to this contract that will continue to protect the puppy, the Buyer(s) and the Breeder.  If Buyer(s) sells, places or otherwise gives this puppy to another home without Breeder's consent, all health guarantees in this contract become void and Buyer(s) by signature on this contract agree to accept responsibility for all legal, transportation and other expenses involved in reclaiming/repossessing the puppy.  This puppy leaves the Breeder's home properly socialized and conditioned and Breeder expects it to be returned the same.  If puppy develops behaviorial issues while in the care of the Buyer(s), it is Buyer(s)'s fault and Buyer(s)'s responsibility to have the puppy and themselves professionally retrained to resolve those issues.  Buyer(s) agrees to undergo retraining with puppy or to pay Breeder to have the puppy retrained and to pay for any veterinary fees, boarding and care while it undergoes said retraining so it can be safely rehomed.  Under no circumstances may this puppy be disposed of at a Pound, Humane Society, Animal Shelter, Pet Store, Breeder (unless agreed upon by Breeder), or given to an individual associated with a puppy mill. Legal action to reclaim puppy and/or fine Buyer(s) to the maximum amount allowed by small claims court law will be taken by Breeder against Buyer(s) should such occur.

*In the case of Surrender, Return or Breeder's Reclaiming of the puppy for any cause, all health records must be properly assigned to Breeder and must accompany the puppy at the time of the return.  Buyer(s)'s signature below is evidence and permission that the Buyer(s) releases all rights of ownership to the puppy and releases and gives permission to veterinarians and other relevant parties to provide all of the puppy's records to the Breeder.

The Breeder and the Buyer(s) mutually agree that this agreement has been entered into in Craven County, NC regardless of where it is signed and that the proper venue for any legal action taken to enforce the terms and conditions of this contract shall lie in Craven County, NC. This agreement shall be interpreted in accordance with the laws of the state of North Carolina.
